By accessing or using our website, placing an order, or engaging with any of our services, you agree to comply with these Terms. • 2. Eligibility
2.1 - Cameron Fuller Limited provides products exclusively to trade customers.
2.2 - Customers must hold a valid trade account to place orders and must ensure their account details are kept up-to-date.
• 3. Product Information
3.1 - We make every effort to provide accurate descriptions, dimensions, and images of our products. However, variations in colours, finishes, or dimensions may occur due to manufacturing processes or screen settings.
3.2 - Custom or bespoke products (e.g., bent tracks or made-to-measure items) are crafted to order and are non-returnable.
• 4. Orders
4.1 - All orders must be placed through our approved ordering channels, including email, post or by phone.
4.2 - By placing an order with us, you confirm that all information provided, including but not limited to product specifications, quantities, and delivery details, is accurate and up to date.
4.3 - Orders will be considered accepted by Cameron Fuller Limited once we have issued an order confirmation, either by email or another agreed communication method.
4.4 - We reserve the right to refuse or cancel any order at our discretion, including, but not limited to, cases where we cannot verify stock availability, payment issues arise, or we detect any fraudulent activity.
• 5. Pricing
5.1 - All prices are quoted in GBP and are exclusive of VAT, unless otherwise specified. The prices listed are trade prices and are only available to registered trade customers.
5.2 - We reserve the right to change prices at any time. However, any price changes will not affect orders already placed and confirmed.
5.3 - Delivery charges will be calculated at the time of the order and communicated to you prior to payment or dispatch.
• 6. Payment Terms
6.1 - Payment for goods is due in accordance with the terms set out in your individual credit agreement, if applicable. If no credit terms have been agreed, full payment is required prior to dispatch.
6.2 - We reserve the right to suspend or cancel any future orders if payment is not received within the agreed terms.
6.3 - Payment methods accepted include bank transfer, cheque, or other methods as agreed upon in your credit account terms.
6.4 - You are responsible for ensuring that payment details provided are accurate and up to date. Any delays or issues resulting from incorrect payment information are not our responsibility.
• 7. Delivery
7.1 - Delivery times are provided as estimates and cannot be guaranteed. We are not liable for delays caused by courier services, weather conditions, or other unforeseen circumstances.
7.2 - Risk in the goods passes to you upon delivery. However, title to the goods remains with Cameron Fuller Limited until full payment for the goods has been received.
7.3 - The customer must inspect goods upon delivery and report any discrepancies, including damages, missing items, or incorrect products, within 3 days. Reports made after this period may not be accepted.
7.4 - Risk of loss or damage to goods passes to the customer upon delivery.
7.5 - If you are unable to accept delivery for any reason, we reserve the right to charge for re-delivery or return of goods.
• 8. Returns and Cancellations
8.1 - We accept returns of faulty or damaged goods within 3 days of delivery. You must notify us of any defects or damages within this period. After this time, we are not liable for any return requests unless covered by warranty.
8.2 - If the goods are returned due to being faulty or damaged, we will arrange for the return and either issue a replacement or a credit, at our discretion.
8.3 - You may cancel your order before it is dispatched. Once the goods have been dispatched, cancellations will not be accepted, and returns must follow the process outlined in section 8.1.
8.4 - Returned goods must be in their original condition and packaging. Any goods returned in a damaged or used state may not be accepted for a credit or replacement.
8.5 - You are responsible for the cost of returning goods, unless the return is due to a fault on our part.
• 9. Fitting and Installation
9.1 Cameron Fuller Limited is not responsible for any fitting or installation costs incurred by the customer, regardless of whether errors arise from incorrect measurements, improper installation, or any product faults.
9.2 It is the customer’s responsibility to verify all product specifications and measurements before proceeding with installation.
9.3 In the event of an error or defect, our liability is limited to replacing the product or issuing a refund in accordance with our Returns and Warranties policies. Under no circumstances will we cover or reimburse any third-party fitting or installation charges.
9.4 The customer is responsible for ensuring that products are used, stored, and maintained in accordance with any provided instructions or guidelines.
9.5 Any misuse, neglect, or unauthorized alterations to the product voids all warranties and liability.
• 10. Warranties
10.1 - We provide a warranty on our products against manufacturing defects for a period of 1 year from the date of delivery, provided that the goods are used and maintained as intended.
10.2 - The warranty does not cover damage caused by misuse, improper installation, accidents, or neglect.
10.3 - If a product is found to be defective within the warranty period, we will, at our discretion, either repair or replace the product or provide a refund, provided the product is returned to us in accordance with our returns process.
10.4 - The warranty is only valid for the original purchaser and is non-transferable.
• 11. Liability
11.1 - Our liability to you for any claim arising from the sale of goods or services is limited to the price of the goods or services purchased, excluding any additional costs such as delivery or installation.
11.2 - We are not liable for any indirect, special, or consequential losses or damages, including but not limited to loss of profit, loss of revenue, or loss of business, arising from the use of our products or services, whether in contract, tort (including negligence), or otherwise.
11.3 - We do not accept liability for any defects or damages that occur after the goods have been delivered and accepted by you, except where such defects arise from a manufacturing fault covered by our warranty.
11.4 - Nothing in these Terms shall exclude or limit our liability for death or personal injury caused by our negligence or any other liability which cannot be excluded or limited by law.
• 12. Limitation on Advice Provided
12.1 Any guidance, recommendations, or advice provided by Cameron Fuller Limited, whether in writing, verbally, or otherwise, is offered in good faith but does not constitute professional advice. The customer is responsible for ensuring the suitability of products for their intended purpose.
• 13. Intellectual Property
13.1 - All content, trademarks, logos, designs, images, and other intellectual property displayed on our website or in relation to our products and services are owned by or licensed to Cameron Fuller Limited.
13.2 - You are granted a limited, non-exclusive, non-transferable license to use our website and products solely for your own business purposes and in accordance with these Terms.
13.3 - You may not reproduce, distribute, modify, or otherwise use any of our intellectual property without prior written permission, except as expressly permitted by these Terms.
13.4 - All rights not expressly granted herein are reserved by Cameron Fuller Limited.
• 14. Governing Law and Dispute Resolution
14.1 - These Terms shall be governed by and construed in accordance with the laws of England and Wales.
14.2 - Any dispute arising out of or in connection with these Terms or any contract between us and you shall be subject to the exclusive jurisdiction of the courts of England and Wales.
14.3 - In the event of a dispute, we encourage you to contact us directly to resolve the matter amicably. If a resolution cannot be reached, the dispute may be referred to mediation or arbitration, as agreed by both parties.
14.4 - If a dispute cannot be resolved through mediation or arbitration, it shall be resolved through the courts as outlined in section 14.2.
• 15. Custom and Made-to-Measure Products
15.1 Custom or made-to-measure products are manufactured to the specifications provided by the customer and are therefore non-refundable unless found to be defective.
15.2 It is the customer’s responsibility to provide accurate measurements and specifications. Cameron Fuller Limited is not liable for errors resulting from inaccurate information provided.
15.3 Once production has begun, cancellations or changes to custom orders cannot be accommodated.
• 16. Miscellaneous
16.1 - Force Majeure: We shall not be held liable for any failure or delay in the performance of our obligations under these Terms due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, strikes, or issues with third-party carriers.
16.2 - Severability: If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.
16.3 - Waiver: Any failure by Cameron Fuller Limited to enforce any of these Terms shall not be deemed a waiver of any rights or provisions.
16.4 - Entire Agreement: These Terms, together with any other documents referred to herein, constitute the entire agreement between you and Cameron Fuller Limited concerning your use of the website and the purchase of goods.
16.5 - Assignment: You may not assign, transfer, or sublicense any of your rights or obligations under these Terms without our prior written consent.
